Terms of service

These terms is a working draft, written to be reviewed rather than relied on. It has not been checked by a lawyer and does not bind anyone. It must not go live before legal review.

1. Who this is between

These terms are between The Quarters B.V., a company registered in the Netherlands (“we”, “us”), and the organisation that opens an account (“you”). They cover use of the The Quarters application and this website.

2. Your account

You are responsible for who you invite into your organisation and what they do with the access you give them. Keep credentials to yourself; tell us promptly at security@thequarter.ai if you think an account has been compromised.

3. The trial

New organisations get 30 days at no cost and without providing a payment method. At the end of it the account becomes read-only: nothing is deleted, nothing is sent, and export continues to work. Adding a payment method resumes the service where it stopped.

4. What it costs

Per unit, per month, at the rates published on our pricing page, subject to a minimum of €99 per month. A unit is one active rentable property in your account, counted on your billing date. Prices are exclusive of VAT.

Annual billing is a twelve-month term at the lower rate. Monthly billing has no minimum term. We will give at least 30 days’ notice before changing prices, and a change never applies inside a term you have already paid for.

5. Payment

Payments are taken by Mollie B.V. by SEPA direct debit or card. If a payment fails we will tell you and try again; if it keeps failing we may make the account read-only until it is resolved. We will not delete anything for non-payment.

6. Your data

Your data is yours. We claim no ownership of it, we do not sell it, and we do not use it to train machine-learning models. Where it includes personal data of your tenants, we act as your processor under the data processing agreement, which forms part of these terms.

Export is available at any time while the account is open, and for 90 days after it closes. After that we delete it.

7. What we promise, and what we do not

We will provide the service with reasonable skill and care and will not deliberately degrade it. We do not promise it will be uninterrupted or error-free, and we do not currently offer a contractual uptime guarantee. If you need one, that is an Enterprise conversation.

The Quarters does not give legal advice. The tenancy agreements it produces are generated from templates you supply and are your responsibility. Whether an agreement is valid, enforceable, or compliant with the rental law that applies to you is a question for your lawyer, not for this software.

8. Acceptable use

Do not use the service to break the law, to send unsolicited bulk email, to store material you have no right to store, or to attempt to reach another organisation’s data. Do not attempt to disrupt the service for others. Security research against your own account is welcome; see the security page.

9. Ending it

You can close your account at any time. On monthly billing the service runs to the end of the paid month; on annual billing to the end of the term. We do not refund unused time, and we do not make you phone anyone to cancel.

We may suspend or end an account for serious or repeated breach of these terms, and we will tell you why and give you a chance to fix it first unless the breach makes that impossible.

10. Liability

Neither of us excludes liability for anything that cannot lawfully be excluded. Subject to that, our total liability in any twelve-month period is limited to the fees you paid us in that period, and neither of us is liable to the other for indirect or consequential loss.

11. Changes to these terms

If we change them materially we will tell you at least 30 days beforehand. If you do not accept the change you may close your account before it takes effect and we will refund the unused portion of any annual term.

12. Law

Dutch law applies, and the courts of Amsterdam have jurisdiction. Nothing here removes rights you have under mandatory law where you are established.
